The intensity of traffic on the roads is growing every year. In this regard, the role of organizations responsible for order in them will also increase. The structure that controls and regulates the markets for transport services began to operate in Russia in 1990. In autumn 2010, the 20th anniversary of the formation of state transport control bodies in the system of the Ministry of Transport is celebrated Russian Federation. Perhaps, for someone the existence of our organization will really be a revelation. But I note that the Directorate is the legal successor of the Bashkir Republican Branch of the Russian Transport Inspectorate, and this name is well known to many. So I would not classify our organization as a little-known one. Another thing is that some people do not know about us, although they encounter those whom we control on a daily basis. Our competence includes state control over the observance of order in the road complex. Under our control are such transport organizations as State Unitary Enterprise "Bashavtotrans", LLC " Pan Auto", Company " Ufa-line”and others, as well as entrepreneurs engaged in the transportation of passengers and goods.

The Authority licenses passenger transportation activities by car, and also issues certificates of admission to international road transport and special permits for the transport of dangerous goods in international traffic. Thus, conditions are created for the normal functioning of the transport services market related to the transportation of passengers and goods. In addition to monitoring compliance with licensing requirements, regulations governing the activities of road transport and the road sector, our service supervises compliance with the legislation of the Russian Federation, including international treaties Russia on the procedure for the implementation of international road transport, weight control of vehicles engaged in freight transportation. It also checks compliance with the requirements of regulatory documents in the design, construction, reconstruction, repair and maintenance of public roads.

In a word, all the daily activities of the Department are aimed at observing socially significant interests in the field of security traffic, preservation of life and health of citizens during the transportation of passengers by road and freight traffic. How does your Office influence the organization of transport services in municipalities and improve the quality of transport services provided?

This, of course, is given due attention. In accordance with federal legislation, the responsibility for organizing transport services in municipalities is assigned to local governments. And we, in turn, control how they exercise these powers. Thus, since the beginning of the year, local self-government bodies of 10 municipalities of the republic have been inspected on the organization of transport services and the creation of conditions for the provision of transport services to the population.

With regard to the quality of the services provided, when carrying out our control measures, the Department, first of all, pays attention to the safety of transportation. To this end, a specially created commission of the Department regularly conducts certification of executive heads and specialists of motor transport enterprises - mechanics, dispatchers and other specialists responsible for the safety of vehicles for the right to occupy their positions. It also checks the level of qualification training of specialists related to the organization of transportation of passengers and goods by road in the Russian Federation. When carrying out this work, the main attention is paid to the availability, knowledge and performance by executive managers and specialists of official duties to ensure the safe operation of vehicles.

For 7 months of 2010, more than 500 executive managers and specialists related to road safety were certified. About 200 people did not pass certification. In connection with negative results certification of 90 specialists suspended from their duties. And for improper performance of official duties to ensure road safety, 4 vehicle specialists were sent for early recertification.

— How often are you contacted for licenses? What is the meaning of the license for passengers?

If we talk only about the last period, then for seven months of 2010 we issued one special permit for the international transportation of dangerous goods by road, 43 licenses for the carriage of passengers by road (for the same period in 2009, 45 licenses were issued). Almost 4,000 license cards have been issued for motor vehicles carrying passengers, which is 40 percent more than in 7 months of 2009.

Over the past period of 2010, the Department's specialists conducted over 500 inspections of economic entities operating in the field of road transport in the territory of the Republic of Bashkortostan. Including 218 inspections of license holders and 269 inspections of road transport entities whose activities are not subject to licensing.

Having a license is a prerequisite for legal business activities. But it is possible to ensure the safety of transportation only through the implementation of high-quality control measures, both planned and unscheduled. When issuing a license, we check all the documentation submitted by the entrepreneur. The license entitles the owner of a motor transport company or entrepreneur to engage in this type of activity, at the same time it imposes on them the obligation to control safety. They are responsible for the serviceability of the car and the condition of the driver and, accordingly, must control the pre-trip medical examination, technical inspection. The department has the right to carry out a scheduled inspection only once every three years. Unscheduled - in accordance with Federal Law No. 294 on the basis of the expiration of the deadline for the execution of a previously issued order or upon receipt by the department of information about a threat to life, health of citizens. In addition, departure to the carrier's line must be agreed with the administration of the municipality. The established route is developed taking into account the passenger traffic. If an entrepreneur goes on someone else's route, then he violates the traffic schedule, which increases the risk of traffic accidents and injuries.

It should be noted that the carrier company, in which case, is responsible for the damage caused together with the driver. I note that the punishment for negligently causing major damage or causing grievous bodily harm has recently been tightened to seven years in prison. Let me give you one of the recent cases as an example. In Sterlitamak, a bus driver of a licensed transport company knocked down an orphanage boy. Okay, not dead. But the child had to be treated for a long time. The investigation has not yet been completed, but we hope that the entrepreneur who put this particular guy behind the wheel, and, of course, the driver himself, will be held accountable for the incident to the fullest extent of the law. I want to emphasize that most often misunderstandings and accidents occur precisely with those carriers that neglect the requirements of the law in pursuit of a long ruble.

— It is in your competence to control the weight of vehicles, but why is this necessary?

The weight of the vehicle is a very serious criterion, especially in cases where some loaded tractor is driving along the road, crushing the asphalt under it. Moreover, a bridge or other structures on the way can collapse under it. In other words, it causes huge material damage, not to mention the fact that it provokes a traffic accident with all the ensuing consequences. For the passage of heavy vehicles, a special permit is required, according to which the route, escort, and in some cases, the existence of a project providing for special measures to strengthen engineering structures are determined.

During inspections on federal highways, only since the beginning of 2010, we have identified 312 cases of unauthorized passage of vehicles with excess weight parameters. The damage caused to federal roads exceeds one million rubles. By the way, local residents or other caring road users can be of great help in maintaining order on the roads. A person sees, for example, how a heavy vehicle is driving along the road, destroying it, he can report this to the round-the-clock duty officer of the Office by phone and send a written request indicating the state number of the car vehicle violator.

Do your interests overlap with other regulators? How do you interact with them?

Of course, we work in close cooperation with other control and supervision, law enforcement agencies, public organizations and associations. As for the service directly working on the road (I'm talking about the traffic police), its employees, to some extent, are our colleagues, partners. But our powers are clearly divided by law. The traffic police control the implementation of the requirements for ensuring road safety directly when road users carry passengers and goods by road and monitors the implementation of traffic rules on the street road network and transport infrastructure facilities. Our Department exercises control in the field of ensuring road safety through the issuance of established permits for the transportation of passengers and goods by road, as well as by monitoring the fulfillment of license requirements and conditions when carrying out a licensed type of activity in road transport. Special attention when exercising control and supervision activities, the Department pays attention to interaction with other regulatory bodies. For example, we work with the FSB when carrying out antiterrorist measures at transport infrastructure facilities. We also conduct joint inspections with Rospotrebnadzor, the Prosecutor's Office, and local governments.

— How is the perpetrator held accountable?

Since the beginning of 2010 alone, the Department’s specialists have drawn up and sent to the judicial authorities of Bashkortostan 173 protocols on administrative offenses(for the same period in 2009 137 protocols). By a court decision, 112 carriers who committed violations were brought to administrative responsibility with a fine totaling 247,200 rubles. As a result of the control measures taken, 1,311 violations of the requirements of the transport legislation, which determines the procedure for organizing and carrying out passenger transportation by road, were identified, 183 orders were issued to eliminate the identified violations, more than half of which were fulfilled, and 82 orders are at the stage of execution and control. In business entities where accidents occurred on licensed passenger vehicles, the Department conducted 12 inspections to ensure compliance with license requirements and conditions. Based on the results of inspections, 7 protocols on administrative offenses were drawn up, which were sent to the judicial authorities for a decision on bringing to administrative responsibility.

The accident rate for 7 months of 2010 on licensed passenger transport decreased by 8 percent compared to the same period in 2009, there were no deaths, the number of injured decreased by 13 percent.

In order to carry out high-quality control and supervision measures in relation to carriers that allow systematic violations of the norms and rules that ensure the safety of passenger transportation, the Office during 2009-2010. in eight cases, administrative materials were sent to the judicial authorities for a decision on the administrative suspension of activities with the subsequent cancellation of the license. For six of them, a decision was made to requalify part 4 of article 14.1 of the Code of Administrative Offenses of the Russian Federation for part 3 of article 14.1 of the Code of Administrative Offenses of the Russian Federation in the form of a fine. This, in my opinion, is too mild a measure, given the possible tragic consequences. According to one material in 2009, there was a suspension of activities, two materials are being processed by the court. In addition, information about systematic violations was sent to the then acting Ministry of Construction, Architecture and Transport of the Republic of Bashkortostan, the Prosecutor's Office and other regulatory bodies.

The situation on the roads is getting worse. Does the legislation react to this, are the measures tougher for violators of traffic rules?

As I said, due to the increase in traffic intensity, the legislation is changing towards tougher penalties, which, I hope, will force carriers to be more disciplined. Thus, in July of this year, amendments were made to certain legislative acts of the Russian Federation in connection with ensuring transport security. They are enshrined in Federal Law No. 195. In particular, the Criminal Code of the Russian Federation includes an article “Failure to comply with the requirements for ensuring transport security at transport infrastructure and vehicles”. It applies to persons responsible for ensuring such security, if the specified violation caused, through negligence, the infliction of grievous bodily harm or major damage (more than one million rubles), the death of one or more persons. The punishment provided for by the Criminal Code is up to seven years in prison.

Amendments to the Code of Administrative Offenses of the Russian Federation have tightened liability for damage to transport equipment, railway tracks, leaving or dropping objects on them that can disrupt train traffic. Also, now they will be punished for failure to comply with transport security requirements and failure to provide information about acts of unlawful interference at transport infrastructure facilities and vehicles.

Could you give some practical advice how to behave, where to contact citizens in case of disorder.

Unfortunately, legal nihilism and indifference are not easily overcome. But, I must say, there are more and more responsible citizens. They call us with complaints. This alone is not enough for us to respond appropriately. The basis for the inspection of the commission is a written application, which indicates the state number and the specific fact of the threat to the safety of life and health of citizens. If there are witnesses, please provide their details. And, of course, the applicants themselves must sign. For example, passengers of a fixed-route taxi are suspicious of a specific smell and inappropriate behavior of the driver, who, moreover, grossly violates the rules of the road, or the car is clearly out of order, etc. Citizens can, having agreed, write a general statement to our Office indicating the fact of the violation, the coordinates of the taxi and their data. Maybe even with a video application because now many cell phones have built-in photo and video cameras.

For reserve colonel Sergei Merezhko, the outgoing year 2007 will remain a memorable year for the rest of his life, because it was then that a regional branch was formed in Ufa Russian club Orthodox patrons(RKPM) for the Republic of Bashkortostan, which he headed. Life twists and turns

Exactly 40 years ago, a boy was born in Orenburg, named Sergei - in honor of his heavenly patron, hegumen of the Russian land - St. Sergius of Radonezh. True, in those unkind times for Orthodoxy, the family preferred not to mention it aloud. And only when the boy was 7 years old, his great-grandmothers - Matryona and Evdokia baptized him in the church, and the father himself became the godfather.
- In those years, I was childishly naive about faith, nevertheless - it's hard to explain - I always felt that the Lord does not allow this thin thread to break in my soul, - says Sergey Nikolayevich. - After leaving school, I entered the Orenburg Higher Anti-Aircraft Missile School and graduated in 1988 with the rank of lieutenant. My position was called platoon commander - teacher, and I began to train specialists for the air defense forces at the training center.
Gradually, the sprouts of faith in the soul of the young officer began to grow stronger. Once at the harvest, an unpleasant incident occurred - a skirmish between a group of military personnel and civilians. Merezhko, like other officers, was in big trouble, up to and including dismissal from the army. In that difficult moment, the mother of one of the soldiers handed him a piece of paper with a handwritten prayer "Our Father": "Pray, son, and the Lord will settle everything." And indeed, Sergey recalls, everything ended well - without nervous shocks, and even more so - without any legal consequences. It was truly help from above, forcing the officer to think more and more seriously about the spiritual power of Orthodoxy. He began to go to church and then consciously put on a pectoral cross.
The collapse of the Union was approaching, and Sergey, by the will of fate, moved to Ufa, where he continued to serve. In 1992, the tax police began to be created in the Bashkir capital. The Department of Tax Investigations, where Captain Merezhko was sent, was created from seconded officers of the KGB, the Ministry of Internal Affairs and the Armed Forces. At first, he served in the physical protection unit, in the anti-corruption department, as an investigator, then as an investigator for especially important cases (at that time he was already studying in absentia at the law faculty of the Bashkir State University).
- I was interested in working in law enforcement agencies- Sergey notes. - And in 1999 I was appointed head of the legal department of the tax police of the Republic of Bashkortostan. And three years later I was invited to work at the Federal Treasury, and I retired as a lieutenant colonel due to my seniority. I worked there for a year, and again a sharp turn - I ended up in the Ministry of Justice of the Russian Federation and again returned to the "shoulder straps". I am very grateful to fate that on its own life path I met such a wise teacher and mentor as Lieutenant General Engels Varisovich Kulmukhametov, the former head of the Bashkir tax police. At that moment he worked as the chief federal inspector for the Republic of Bashkortostan. And for the past four years I have been his pro bono chief legal adviser.
Such a serious and responsible life school taught Merezhko a lot. Last year he received the rank of colonel, and in mid-2007 he made a cardinal decision - to retire in order to devote himself entirely to work in the regional branch of the Russian Club of Orthodox Patrons that had just opened in Ufa.
What is a patron?
“Everything happened by the will of God,” says Sergey Nikolayevich. - Andrey Poklonsky, Chairman of the Board of the RKPM, asked me to assist in obtaining a blessing for the opening of the Bashkir branch of the club from the Archbishop of Ufa and Sterlitamak Nikon. During our meeting, I turned to Vladyka with a request from the club to also recommend someone to the position of the chairman of the department. “I have no other candidates besides you,” he suddenly said. I will not hide - I was inspired (after all, deep down I wanted the same!) And asked him to bless me to leave the public service and direct all my efforts to the development of this project.
Of course, the process of our formation is not easy: in March 2007 we registered. So far, there are not so many members of the branch, but a strong core of Orthodox entrepreneurs has already formed. In addition, there is such a thing as a friend of the club. So far, such people are looking closely at our affairs, carefully making contacts, and they can be understood - most likely, they have already “burned themselves” on various early maturing funds.
For example, I have an old comrade-in-arms in the army (now he is also in reserve) - a Muslim by faith. I suggested that he lead social projects together - after all, children or the elderly who need help should receive it, regardless of their belonging to a particular nationality or confession. “Russia is our common home, we have been living on the same land for more than one century,” I told him. “So let’s build our house together!”

I can say that recently in Ufa, following the example of the Russian Club of Orthodox Patrons, a Club of Muslim Patrons was created. Now we have already implemented a joint action.
We are talking about a charitable client-oriented training, which was held for Bashkir entrepreneurs by representatives of the RKPM from Moscow, the best specialists in management consulting. The funds collected from him were immediately directed to help orphans from orphanage in Blagoveshchensk. Having learned what they specifically needed, we bought and delivered sportswear and equipment to the children, as well as a chainsaw for their future rafting trips). This action received coverage on local television and on the pages of the republican business magazine "Hype" - its participant and our information partner.
It seems to me that the concept of “philanthropist” should not be understood as follows: here came a certain moneybag with a tightly stuffed wallet, took out a wad of money, clapped: “Here, buy or build something there!” No, we are not such patrons! As for wealthy and rich people, we do not ask them for money, we provide them with the opportunity, as was the case with the participants of that very training, to benefit their company by acquiring a modern intellectual product, joining modern methods management and training, and send the proceeds to charity.
I believe that a philanthropist is someone who, at the call of his soul and heart, consciously helps people: moreover, he does not have to be related to business people; a person of any profession is able to be useful - he can support with his administrative resources, rich life experience, intellect, professional background, and, of course, capital.
For example, in the RCPM there is a project "Gift of God", which provides for the support of the most gifted children and the Orthodox upbringing of children in general. How can a modest teacher of foreign languages ​​or a musician help here with their meager salaries? The first can prepare a child from an orphanage with the makings of a future polyglot, the second can train a musically gifted child. There are many such examples...
We are also involved in the work of the diocese in the Orthodox upbringing of children and youth. Last summer, we helped organize an Orthodox youth camp near Ufa - we sent its participants on buses, organized some events, including the closing of the camp with fireworks, handed everyone a jar of Bashkir honey with the club's logo and other gifts. Now we dream of renting the land ourselves, putting up summer houses there and setting up our own camp for children under the auspices of our department.
Specifically for projects
Last summer, on one of the busy streets of Ufa, in the building of the former convent, the workshop "Measured Icon" was opened, where everyone can order for their child, themselves or their loved ones an icon of his heavenly patron or any other icon close to his heart. So, thanks to the regional branch of the RKPM, one of the club's priority projects came to Bashkiria.
If we talk about this project as a whole, then during its work, the most experienced icon painters, primarily in Moscow and the Moscow region, completely restored the special ancient technique of painting icons, collected the rarest images of saints.
- The revival of the Ufa icon-painting traditions in our country is carried out with the most ardent support of the Moscow workshop "Measured Icon", - Sergey Nikolayevich notes. - We started our project from scratch - we renovated the premises and began to look for craftsmen. Now we already have seven masters along with students. And people come: Orthodox and, interestingly, Muslims who order measured icons as gifts for the families of their Orthodox friends. We also make wooden crucifixes and icon cases. In principle, we want to unite here all the icon painters of Bashkiria and give new life our Ural school of icon painting.
Another area of ​​activity of the department is cooperation with the iconostasis workshop at the Exaltation of the Cross Church in Ufa. Actually, the workshop itself, headed by Dmitry Molev (now a member of the RKPM), has been operating for seven years, two dozen iconostases made by her adorn churches not only in Bashkiria, but also in other regions of Russia. Recently, a wonderful iconostasis was installed in the Nizhny Novgorod church, and now the brothers (as Dmitry calls his work team) are working on orders for Izhevsk and Kemerovo.
- This is an amazing super-project of the club, uniting both the regions of Russia and the Slavic states, - Sergey Nikolaevich admires. - After all, it is aimed at attracting our compatriots to the Church, expanding the “territory of goodness and mercy” through the revival of the tradition of building ordinary (“one day”) churches in Russia. At the first stage, it is planned to build such a temple in the spring of 2008 just in Kemerovo - geographic center Russia, on the second - in the capitals of Orthodox states - Moscow, Kyiv, Minsk, on the third - seven churches are being built in one day in seven federal districts of Russia.
“There is not much time left,” Merezhko says with concern, “and the pilot project prepared by us for Kemerovo (we took the model of a Russian temple of the 8th-9th centuries as a basis) is quite complicated. In the foundation, it is an octahedron (one side 4 meters long), symbolizing the Star of Bethlehem; height to the cross - 17 meters, area without an altar - 57 square meters, that is, the temple can accommodate just over 100 people. Now we are working on everything to the smallest detail, because - do not forget! - You need to build a temple in one day.
Of course, all our affairs (even just the opening of the Trapeza cafe in Ufa), adds Sergey Nikolayevich, we do with the blessing of Vladyka Nikon, this outstanding pastor of the Russian Orthodox Church, who managed to build and restore from the ruins many dozens of temples and monasteries.
What gives army hardening
Speaking about the future development of the regional branch and the club as a whole, Merezhko notes:
- We intend not to rest on our laurels, but with God's help to move forward, multiplying our good deeds. I have already spoken about some of our ideas. We want to show that money is not the main thing in life. When a person has faith and love for his neighbor, he will succeed.
It should also be borne in mind that the Republic of Bashkortostan is a strong region in itself. When I worked in the apparatus of the Plenipotentiary of the President of the Russian Federation for the Volga federal district and studied the analytics of the development of 15 subjects that make up the district, I was convinced that Bashkiria, developing not quite similar to other regions and continuing the traditions already established here, has a dynamic potential. This is a very interesting region for investments. There are good growth prospects, valuable resources, excellent personnel and a strong base for their training. I think that our regional branch of the RKPM has good soil, and the seeds sown in it will give abundant sprouts.

The Federal Service for Supervision in the Sphere of Transport is responsible for various issues. Which ones are on this moment are the most relevant?

Areas of activity that require great attention, regardless of time, are the safety of the transport of citizens and the safety of the transport of dangerous goods. And our responsible task is to exercise control and supervision over strict compliance with the legislation of the Russian Federation. The department grants a license for the right to transport passengers by road transport equipped for transportation of more than eight people, checks for compliance with license requirements. We also control international transportation: and this is not only transportation by residents of the republic, but also transit transportation by foreign citizens. Another aspect of the Department's activities is the issuance of special permits for traffic on highways a vehicle transporting dangerous goods, certificates of admission to international road transport. Last year, we did colossal work in this direction: more than two thousand traffic routes were agreed upon. We also monitor compliance with the requirements for the safety of federal roads: M5, M7 and Ufa-Orenburg. We control the condition of the road surface, bridges and overpasses, stopping points, take measures against the appearance of unauthorized exits. And we can say that the roads in the republic are in good condition.

The sphere of passenger transportation always causes a lot of discussions?

Yes, indeed, we are often asked to put things in order in the area of ​​supposedly illegal transportation. But the fact is that we do not have such in our republic: the carrier either has an appropriate license, or carries out activities for the transportation of passengers, which have a notification character. Of course, isolated cases are revealed - once or twice a year, but these are rather private bus drivers who decided to make money. As for entrepreneurs who do not participate in the competition of the municipality and operate in parallel with official carriers, I think that businesses need to resolve this issue on their own, by increasing the number of buses at their enterprise, or by entering into contractual relations with partners in this area. Relationships within the business need a certain settlement on a legal basis. We do not interfere in the work of business structures. We are told: "You gave a license - you will put things in order." But the licensee has everything in order, everything is observed, because the conclusion of an agreement for the route is not a license requirement. If a violation is detected, then tough measures are applied: appropriate penalties.

What points should passengers pay special attention to?

Effective from the beginning of last year the federal law on compulsory insurance of civil liability of the carrier for causing damage to life, health, property of passengers during transportation. The amount of insurance compensation to the victim reaches two million rubles. When boarding a bus, a passenger has the right to make sure that his trip is insured by the carrier. But after all, many, using public transport, do not even think that their life and health may not be insured.

What to do if a passenger has claims against carriers?

Unfortunately, passengers still have to deal with negligent drivers who are rude to them, go to the route on a dirty bus. The carrier is obliged to provide safe and high-quality services, issue a ticket, inform about the licensee, the insurer. A citizen has the right to choose: not to get on the bus or interrupt the trip if something does not suit him. After all, it is one thing to go on a route on a dirty bus, another thing is the lack of seat belts in it. Therefore, the size of the fine should encourage them to adjust their activities in accordance with the requirements, standards and norms of the law. And you know, there has been a very positive trend towards this over the past few years. A small example: over the past five years, the number of gazelles has significantly decreased, while the number of comfortable foreign-made minibuses has increased. The renewal of the fleet is one of the factors that indicates changes in better side in the approach to the business of businessmen in this area, in ensuring security and quality of service.
